Public offer for the provision of non-refundable financial assistance (grant)

LIMITED LIABILITY COMPANY “CHRISTIAN ADVENTIST MEDICAL CENTER” (EDRPOU code: 39440963), guided by Article 634 of the Civil Code of Ukraine, publicly offers an indefinite number of individuals with full civil capacity to conclude an agreement on the provision of non-refundable financial assistance (donation) via the Internet, for which purpose it publishes this Agreement on the following:

Organization: LIMITED LIABILITY COMPANY “CHRISTIAN ADVENTIST MEDICAL CENTER” (EDRPOU code: 39440963), represented by Director Bondarenko Yuriy, acting on the basis of the Charter, on the one hand, and the Donor: An individual with full civil capacity, on the other hand, have concluded this Agreement on the provision of non-refundable financial assistance (donation) (hereinafter referred to as the Agreement), the subject and essential terms of which are specified below:

1. Terms and definitions

1.1. Public Offer – a valid offer of the Organization, posted on the official website of the organization https://www.angelia.ua/charity/, to provide non-refundable financial assistance (donation), addressed to an unlimited circle of individuals with full civil capacity.

1.2. Acceptance – full and unconditional acceptance of the Public Offer by taking actions to make a money transfer using the payment forms and means posted on the Organization’s Website. The moment of Acceptance is the date of crediting the funds to the Organization’s bank account.

1.3. Donation/Gift – a free transfer of funds by the Donor into the ownership of the Organization.

2. Subject of the contract

2.1. The subject of this Agreement is the free and voluntary donation and transfer of funds by the Donor to the ownership of the Organization by transferring funds (Donation) by the Donor to the Organization through the payment form available at https://www.angelia.ua/charity/.

3. Procedure for providing non-refundable financial assistance ( gift)

3.1. The donor independently determines the amount of funds (Gift).

3.2. Acceptance of the Offer means that the Donor agrees with all its provisions, is familiar with the goals, objectives of the Organization and areas of its activity and is fully aware of and agrees with the subject matter of the Agreement.

3.3. The Donor and the Organization, guided by Art. 207, Part 2 of Art. 639, Art. 641, 642 of the Civil Code of Ukraine, agree that from the moment of Acceptance the Agreement is considered concluded in writing. At the same time, the Parties agree that failure by the Parties to comply with the written form of the transaction does not mean its invalidity.

3.4. All costs of payment of amounts (commissions) related to the transfer and crediting of non-refundable financial assistance (donation) shall be borne by the Organization.

4. Other conditions

4.1. The Organization has the right to receive non-refundable financial assistance (donations) and use it to carry out the statutory activities of the Organization.

4.2. The Organization has the right, at any time, after the transfer of the gift, within 15 days, to refuse it. In case of refusal of the donation, the Organization returns the gift within 5 days after the decision on refusal is made. In this case, this agreement is considered terminated from the moment the Organization makes a decision on refusal. In case of impossibility to transfer the gift to the Donor, the gift remains at the disposal of the Organization.

4.3. The Offer is valid indefinitely. The Organization has the right to cancel the Offer at any time without giving reasons. Changes and additions may be made to the Offer, which will come into force on the day following the day of their posting on the Organization’s website.

5. Final provisions

5.1. By making the Acceptance, the Donor confirms that he is familiar with and agrees with the terms of Appendix No. 1 to this Agreement regarding the collection and processing of personal data.

5.2. The Organization undertakes not to transfer the email address and other information about the Donor to third parties, except for cases provided for by the current legislation of Ukraine.

By Accepting the public offer to provide non-refundable financial assistance (donation), which is posted on the website of the LIMITED LIABILITY COMPANY “CHRISTIAN ADVENTIST MEDICAL CENTER”: https://www.angelia.ua/charity/, in accordance with the Law of Ukraine “On Personal Data Protection” dated June 1, 2010, No. 2297-VI, I give my consent to the LIMITED LIABILITY COMPANY “CHRISTIAN ADVENTIST MEDICAL CENTER” (hereinafter referred to as the Organization) to process and use in the established manner the personal data provided by me.

By accepting the public offer to provide irrevocable financial assistance (donation), which is posted on the website of the LIMITED LIABILITY COMPANY “CHRISTIAN ADVENTIST MEDICAL CENTER”: https://www.angelia.ua/charity/, I confirm that I have received a notification about the inclusion of my personal data in the personal data base “Donor” for the purpose of implementing the statutory activities of the Organization, involving persons in activities in accordance with the statute of the Organization and the legislation of Ukraine, as well as information about the rights defined by the Law of Ukraine “On Personal Data Protection”.
